The Right of Withdrawal in Hungary: Rules for Online Sellers

The Right of Withdrawal Under Decree 45/2014
The withdrawal right lets a consumer change their mind about a distance purchase and return it for a refund, without giving a reason. For most goods, the consumer has 14 days, and the period generally runs from the day the consumer, or a third party they nominate, takes physical possession of the goods. In Hungary these rules are set out in Government Decree 45/2014, which is the reference point for distance and off-premises contracts.

Information Duties and the Extended Period

If you fail to provide this information, the period can be extended by up to 12 months. Clear pre-contract information is therefore directly relevant to how long customers can return goods.
A model withdrawal form is part of the framework, and you should make it, or an equivalent clear method of withdrawing, readily available so a customer can act without difficulty.
Refunds
When a consumer withdraws, you must refund the payments received, including the standard cost of delivery, within 14 days. The duty covers the basic delivery charge, though not any premium if the consumer chose a more expensive delivery option than your standard offer. Prompt, full refunds are a recurring compliance point for online sellers.
Exceptions to Keep in Mind
The right does not apply to every product. The framework sets out exceptions that affect how you present returns for certain lines.
- Personalised or made-to-order goods produced to the consumer’s specification.
- Perishable goods that can deteriorate quickly.
- Sealed goods unsuitable for return on health or hygiene grounds once unsealed.
Oversight and Language
Consumer protection in Hungary is associated with the national consumer-protection authority, which supervises how these rules are applied. The practical takeaway is that consumer rights are monitored rather than left to self-assessment. Dealings with authorities and consumer-facing information are generally in Hungarian, so if your shop operates primarily in another language, plan for Hungarian-language handling of withdrawal information rather than assuming English will suffice.
